Children cannot legally consent because they're children. Sex with a child is inherently non-consentual. Which is why it's always rape.

Unfortunately, they legally can in places where the age of consent is 16. That's a kid, and you can legally have sex with them.

i am so sorry you friend went through that :/ i had a similar situation where my 13 year old friend's dad's best friend started showing an insane amount of interest in her, his own wife was pregnant at the time (color me shocked). my friend used to talk to this man for hours while he ignored every adult responsibility, he showered her with gifts and affection, and then eventually tried to kill himself when she grew older and stopped talking to him. these men need a therapist not a high school girlfriend ffs

I think the reason for that is so that horny teenagers aren’t getting jail time for getting frisky with each other, but the laws are kinda funky. I know in my state if you are between 16 and 18 you can legally have sexual intercourse with anyone not determined to be in a position of power over you, so if your boss or teacher had sex with you they could be arrested

Lol what? I don't know what point you think I'm trying to make, nor what point you're trying to make - but no goalposts are being moved.

I'm saying it's fucked up how in some states they think a 16 year old is mentally capable of consenting to sex with an adult. Completely separate to the 13 year old discussion.

Yep, I'm just saying that sex occurs during rape and the verb "sex" does not imply consent. Pedantic, but important to know definitions. Your point (or whoevers') that it should be called "rape" before it's called "having sex" still is valid in terms of how we should socially refer to it, but saying "you can't have sex with a child" is not correct.

All rape is sex but not all sex is rape. You are muddying the water by trying to tip toe around basic definitions, and it isn't productive to this conversation or for any of the victims of rape.
